TERMS AND CONDITIONS
VOCAL CHEF STANDARD TERMS & CONDITIONS OF SALE
In this Agreement,
Customer: the person/business who buys goods from Vocal Chef.
Goods: the items supplied by Vocal Chef in the ‘Order’.
Supplier: Vocal Chef, Lichfield, United Kingdom.
Order: any order for goods (excluding Amazon, eBay and Etsy) to accept the purchase of goods at the supplier’s price quotation.
Parties: the customer and Vocal Chef.
Business Day: any day excluding Sundays and bank holidays.
1. Contract
1.1 By submitting an Order, the Customer agrees to apply the terms and conditions of this Agreement. The Order establishes an offer made by the Customer to purchase Goods at the quoted price at the time of Order, in accordance with these conditions.
1.2 Any Order is subject to acceptance by Vocal Chef. Vocal Chef is not obliged to accept any and payment for Goods does not in itself constitute acceptance of the Order. The contract will come into place and the Order will be considered as accepted when Vocal Chef issues written confirmation.
2. Goods being Sold
2.1 Descriptions and specifications for the Goods are set out on the Vocal Chef website at the time of the Order.
2.2 Goods ordered are sold subject to stock availability and Vocal Chef retains the right to substitute the Goods with items of better or comparable quality.
2.3 Vocal Chef my cancel the Order in full, or in part, if any of the Goods on the order are out of stock. Vocal Chef will issue a refund in full for any part of the order which cannot be fulfilled. Otherwise, Vocal Chef may amend the Order, subject to approval from the Customer.
3. Delivery
3.1 Delivery fees stated on the Vocal Chef website are subject to change according to market conditions.
3.2 Next Day delivery orders within the UK mainland will be fulfilled subject to the order being placed before 12pm, excluding Sundays and UK bank holidays. Standard Delivery will approximately be delivered within 3-5 working days.
3.3 Delivery on any orders outside of UK mainland will be delivered within 10 working days and may be subject to additional fees.
3.4 Vocal Chef will use a third party to deliver all Orders to the requested location. Vocal Chef will not be liable for any damage or delays in the delivery of Goods that are out of the Supplier’s control.
3.4 In the event that the delivery of Goods cannot be fulfilled due to the non-acceptance by the Customer, attempt of re-delivery will be subject to additional charges at current market prices.
4. Terms of Payment and Payment Methods
4.1 The Goods shall be payable at the prices listed on the Vocal Chef website at the time of the Order. Delivery charges will be payable in addition to the listed price of Goods and the delivery price quoted at checkout. All prices are quoted in British Pound Sterling. Vocal Chef retains the right to update prices at any time.
4.2 Payment for Goods and Delivery must be made in full by the Customer in advance of the Order being shipped.
5. Quality and Returns
5.1 Vocal Chef guarantees that on delivery Goods shall be free from material defects and match the Goods description. The Supplier will refund or replace any Goods which fall short of the standard guaranteed subject to the Customer giving notice to the Supplier of any defects and the Goods are returned to the Supplier in the condition the Customer received them in, with labels still attached.
5.2 Provided Goods are returned unused, labels attached and in a saleable condition, Goods sold in the UK mainland may be returned for a refund, exchange or replacement within 30 days. Goods that have been opened, marked, damaged or used will be subject to a refund assessment by Vocal Chef on the return of the Goods. The refund assessment will comprise the reason as to why the Goods were returned and the condition the Goods are returned in. The carriage cost of returns may be to the Customer at Vocal Chef’s discretion.
5.3 Goods that are missing from delivery or damaged due to delivery must be reported to Vocal Chef within 2 days from the time of delivery.
6. Termination
6.1 Vocal Chef shall be entitled to cancel or suspend any Order where payment has not been received in full before shipment.
6.3 Vocal chef shall not be liable for any delay in performing obligations of the Contract if the delay is caused by a Force Majeure Event (an event which could not have been foreseen and out of Vocal Chef’s control).
7. Limitation of Liability
7.1 Vocal Chef will not be liable for any losses or damage suffered by the Customer including but not limited to damage premises or connecting premises on delivery, loss of business, business interruption or loss of time due to the use or purchase of the Goods by the Customer.
7.2 Goods sold are not insured for delivery unless otherwise confirmed by the Supplier in writing.
